Terms and Conditions of Business Issued January 26th 2008
These terms and conditions of business outline the basis upon which, Pipeline International Yacht Crew Agency CB, a Palma registered Company will specialize in the introduction of professional yacht personnel (Crew).
Crew or Applicant: Any person or Company submitting their information on the website, making verbal contact to Company agents, or by faxing their details or otherwise indicating their want to find employment by the Company.
Employer: Any person requesting Crew from the Company, this can be the Owner of the vessel, the Captain or any head of department acting on behalf of the Owner or the Captain.
Pipeline International Crew Agency is a referral agency, our role is the introduction of Crew to Clients and any employment agreed upon or contract entered into by the Client and Crew remains the responsibility of the Client.
The Company will make every effort to interview and check candidates references, however it is recommended that the employer conducts their own interview and reference checks prior to entering into an employment agreement.
Fees -
There are no fees for crew wishing to register and seek employment with The Pipeline.
For Employers -
Permenant placement of a Captain - 100% of the first months salary
Permanent placement - 50% of the first month's salary
Seasonal placement - 50% of one month's salary
Temporary placement - 20% of total salary earned
Day work - 50 euros per day per crew member
Day work for more than 14 days will be charged at a temporary placement rate.
All fees subject to VAT at 16%
Crew placement fees are due within 30 days from the first day of employment and the trial period shall be no longer than one month.
In the event that any Crew introduced by Pipeline, are employed or re-employed by the Client within the period of one year from the date of our initial introduction of the Crew member, the client will be charged the applicable placement fee.
Warranty
Warranty shall be valid if the invoice was paid in a timely manner and if the Company is notified within 48 hours of the departure of the Crew member.
Permanent placement - If employment is terminated by either party within the first thirty days of being hired, our fee for finding another candidate will be no charge.
The warranty will be invalidated in any of the following cases -
: Change in Ownership : Change in Captain or more than 50% of the Crew : Major change in schedule from that planned at the time of hire : Failure by the Captain or Owner to provide a safe working environment : Major change in job description from that for which the candidate was hired
Warranty is limited to one replacement.
Rights to information
You, the employer, agree to hold as confidential the identity of the candidates submitted the Company and further agree not to pass on or otherwise distribute resumes or contact information for applicants received from the Company to any third party, other than for the purpose of reference verification. Any resume distributed to a third party shall be classed as a placement made and an invoice submitted to the original recipient for payment for each resume forwarded.
As a Crew member seeking employment you are providing the Company with information and warranting such information as an accurate and a true representation of your experience, skills and qualifications. You further agree that this information may be distributed by the company to third parties without your knowledge for the purpose of finding employment, reference verification or any other purpose deemed appropriate by the Company including release of information for the purpose of background checks and reference verification.
